Terms of Service
1. About Eunoia
Eunoia ('we', 'us', 'our') is a software-as-a-service platform designed to support mental health professionals in the United Kingdom and internationally. These Terms of Service govern your use of our website and services.
2. Eligibility
You must be a qualified or trainee mental health professional (psychotherapist, counsellor, psychologist, or supervised trainee) aged 18 or over to register for Eunoia. By registering, you confirm that you meet this requirement.
3. Account Registration
When you register interest or create an account, you agree to provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
4. Use of the Platform
You may only use Eunoia for lawful professional purposes consistent with your clinical obligations. You must not upload content that is illegal, defamatory, or in breach of patient confidentiality. You are solely responsible for ensuring your use of Eunoia complies with your professional code of ethics and applicable law.
5. Data and Clinical Records
You remain the data controller for any client records you store in Eunoia. We act as your data processor in accordance with our Data Processing Agreement and Privacy Policy. You are responsible for obtaining appropriate consent from clients and for compliance with UK GDPR and the Data Protection Act 2018.
6. AI-Generated Content
Eunoia uses AI to assist with session note generation. All AI-generated content is a draft for your review only. You must review, edit, and approve every note before it enters any clinical record. We accept no liability for errors in AI-generated content that you adopt without appropriate review.
7. Intellectual Property
The Eunoia platform, branding, and software are owned by us and protected by intellectual property law. You are granted a limited, non-transferable licence to use the platform for your own professional purposes. You may not copy, reverse-engineer, or redistribute any part of the platform.
8. Payments and Refunds
Subscription fees are billed in advance. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are issued at our discretion for billing errors or service outages of more than 48 consecutive hours.
9. Limitation of Liability
To the maximum extent permitted by law, Eunoia shall not be liable for any indirect, incidental, or consequential loss arising from your use of the platform. Our total liability for any claim shall not exceed the fees you paid in the three months preceding the claim.
10. Changes to Terms
We may update these terms from time to time. Material changes will be notified by email at least 30 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the revised terms.
11. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
